The Department of Labor Peninsular Malaysia (JTKSM)'s Employment Act (Amendment) 2022 came into force on January 1, 2023. The purpose of the amendment is to:

  • increase and improve the protection and welfare of employees; and
  • ensure that labor law provisions are in accordance with international labor standards.

Here are some important updates:

  • The general penalty has increased from RM10,000 to RM50,000
  • The scope of protection for employees has expanded
  • Employers are now required to display a sexual harassment prevention notice 
  • Flexible work arrangements are now an option
  • The wage calculation formula for incomplete month's work has changed
  • Sick leave and hospitalization leave have been given different definitions & treatments
  • Paternity leave has been introduced
  • The number of days for maternity leave has increased
  • The maximum working hours have been reduced
