(i) Finance Bill 2023 Passed in Parliament with Amendments
The tax relief on amounts deposited into Skim Simpanan Pendidikan Nasional (SSPN) has been extended to 2024. There are additional conditions for SMEs to be eligible for reduced tax rates. The effective date in respect of the additional tax bracket for LLP has been amended to 2024.
(ii) Revised Guidelines for Research & Development (R&D) Status Application
The Malaysian Investment Development Authority (MIDA) has recently revised its guidelines (dated January 1, 2022) for “Contract R&D Company” and “R&D Company” applicants to qualify for R&D status, in line with the measures announced in Budget 2022.
(iii) Extension of Time for Filing of Tax Returns
Extension of time for the filing of tax returns under Labuan Business Activity Tax Act 1990 (LBATA), from March 31, 2023 to July 31, 2023. The Inland Revenue Board is currently digitalizing the filing process under LBATA and the project is expected to be complete by 2025. Labuan entities are required to submit both scanned copies and hard copies of all relevant documents to the Labuan International Section.
